2.2 These General Terms and Conditions apply to all customers. Article 15 sets out specific rules for resellers and business customers.

Article 3 – Order and conclusion of the contract

3.1 The products presented on kurma.ch constitute an invitation to order and not a firm offer.

3.2 To place an order, the customer adds items to their basket, enters their address(es), and chooses a delivery method and payment method. Before confirming, a summary allows them to check and correct all the information entered. The order is submitted by clicking the final confirmation button.

3.3 The customer immediately receives an email acknowledging receipt of their order. The contract is concluded upon sending this confirmation email.

3.4 In the event of a clear error in price or description (for example, a data entry error), we may cancel the order. The customer will then be informed without delay and fully refunded any amounts already paid.

3.5 Orders, invoices and exchanges are archived electronically and can serve as proof.

Article 4 – Product Information

4.1 We describe our products with the utmost care. Stones, crystals, and minerals are natural products: each piece is unique. Color, shape, size, weight, and inclusions may vary slightly from the photos, which are for illustrative purposes only. The dimensions and weights indicated are approximate.

4.2 Natural markings (cracks, inclusions, small cavities, surface irregularities) are part of the character of the stones and do not constitute a defect.

4.3 The properties attributed to stones in lithotherapy are based on traditions and beliefs. They are not scientifically proven and in no way replace medical advice, diagnosis, or treatment. See also our Disclaimer page.

4.4 Offers are valid while stocks last.

Article 5 – Price

5.1 Prices are quoted in Swiss francs (CHF), including Swiss VAT (subject to Article 15 for resellers), excluding delivery charges. Delivery charges are displayed before order confirmation.

5.2 The applicable price is the one displayed at the time of order confirmation.

5.3 The prices shown include Swiss VAT, including for deliveries abroad. Customs duties, taxes of the destination country (including its import VAT) and import fees are the responsibility of the customer (see article 9.6).

5.4 We may refuse an order from a customer who has not paid for a previous order or with whom a payment dispute is ongoing.

  • PostFinance e-finance : the customer is redirected to their e-banking to authorize the payment.

This payment method is subject to a credit check and the general terms and conditions of CembraPay SA . We do not have access to the reasons for any refusal. For any questions regarding the invoice, the customer should contact CembraPay directly.

6.2 The customer guarantees that they are authorized to use the chosen payment method.

6.3 If payment is refused or fails, the order will not be processed. The customer can try again or choose another payment method; our FAQ and customer service can help.

Article 7 – Availability and preparation

7.1 Unless otherwise stated, the order is prepared within 1 to 2 working days after receipt of full payment (for payment by invoice: after order validation).

7.2 If an ordered item is no longer available, the customer will be informed without delay. They will then choose between a replacement item, a voucher for the value of the item, or a refund of the amount paid for that item via the original payment method.

Article 8 – Delivery

8.1 We deliver to Switzerland, Liechtenstein, and the European countries offered during the ordering process. For other destinations, the customer can contact us by email or WhatsApp.

8.2 The available shipping methods, prices and delivery times are displayed in the shopping cart and during the order process, before confirmation. They depend on the destination country, the order amount and the items ordered.

8.3 Shipments are generally handled by Swiss Post. The delivery times indicated begin from the date of dispatch; they are indicative and do not include customs clearance for international shipments. Upon dispatch, the customer receives a confirmation email and, for tracked shipments, a tracking number.

8.4 The customer is responsible for the accuracy of the delivery address. We do not deliver to P.O. boxes. If a package is returned to us due to an incorrect or incomplete address, or because it was not collected, the customer is responsible for the reshipping costs. A refused or unclaimed package will be held for 30 days; after this period, the order will be canceled and the amount paid, less the shipping and return costs, will be refunded as a voucher.

8.5 The customer may request that the invoice be sent to an address different from the delivery address (except for payment by CembraPay invoice).

Article 9 – Risks of transport, loss and theft

9.1 Damaged Package : The customer must check the condition of the package upon receipt. Any damage must be reported to us within 7 days with photos of the package and its contents, while retaining the original packaging. This allows us to file a claim with the postal service.

9.2 Tracked Shipments (Economy, Priority, Signature Required): In case of loss, significant delay, or damage, the customer must notify us. We will open an investigation with the postal service (up to 21 days). If the package is deemed lost or damaged, we will replace it or refund the amount covered by the chosen shipping method: CHF 500 for Economy and Priority shipments, CHF 1,500 for Signature Required shipments, and CHF 5,000 for packages valued at over CHF 1,500 (insurance included). Jewelry and pearls are only covered if sent with signature confirmation.

9.3 Package marked as delivered but not received : If the tracking indicates that the package has been delivered, we are not responsible for any theft that occurs after delivery. We may offer a goodwill gesture in the form of a voucher if the customer provides us with a copy of their police report and a statement from their insurance company indicating that they do not cover the damage.

9.4 Shipments without tracking or insurance (Midilettre A and B, PostPac Mini): In accordance with Swiss law (Art. 185 para. 2 CO), the risk passes to the customer upon delivery of the package to the postal service. As these shipments are less expensive, the customer accepts the risk by choosing them. Upon request, we will initiate a search with the postal service. In case of loss, we may offer compensation under the conditions of Article 9.3.

9.5 Customers domiciled in the European Union : for EU consumers, the risks pass to the customer only upon receipt of the package where the mandatory law of their country provides for it; this right is reserved.

9.6 Customs : For shipments outside Switzerland, the customer is responsible for all formalities, customs duties, taxes, and import fees in the destination country. We cannot guarantee the duration of customs clearance. A package refused for customs reasons is handled according to section 8.4.

Article 10 – Defective or incorrect item (legal guarantee)

10.1 The customer benefits from the statutory warranty against defects (Art. 197 et seq. of the Swiss Code of Obligations) for two years from the date of delivery. The customer must inspect the goods upon receipt and notify us of any defects immediately upon discovery, by email with photographs.

10.2 If the defect is confirmed (by photo or, if necessary, after examination of the item), the customer can choose between exchanging the item, receiving a voucher for its value, or a refund of the item price via the original payment method . Return shipping costs are covered by us: we will send a return label by email.

10.3 If the customer has received an item different from the one ordered, they should contact us as soon as possible. We will send them the correct item and a free return label for the incorrect item.

10.4 The following are not considered defects: natural marks on the stones (article 4.2), normal wear and tear and damage due to misuse, shock or lack of care.

10.5 Commercial Guarantee on Bracelets : In addition to the statutory guarantee, if a bracelet's thread breaks or becomes significantly stretched within 20 days of receipt, under normal use, we will repair or replace it free of charge, including shipping costs. After this period, repairs cost CHF 10 per bracelet, plus any missing beads and shipping costs. This commercial guarantee does not limit your statutory guarantee rights.

Article 11 – Returning an unsuitable item

11.1 Swiss law does not provide for a right of withdrawal for online purchases. However, for customers domiciled in Switzerland and Liechtenstein, we voluntarily offer the possibility of returning an item that is unsuitable (size, taste, customer order error).
